Welcome to Medina Wifi (referred to below as “the Company,” “we,” “us,” or “our”). These General Terms and Conditions govern the rental of our portable Wi-Fi routers, data plans, and all associated accessories (collectively referred to as the “Equipment”) to you (the “Customer,” “you,” or “your”).
By completing a booking and checking the “I agree to the Terms and Conditions” box on our website booking page, you enter into a legally binding agreement with us based on the terms outlined below.
1. Ownership of the Equipment
The Equipment provided to you is, and shall remain at all times, the absolute property of the Company. You are solely a bailee (renter) of the Equipment for the designated rental period specified in your booking confirmation. You have no right to sell, modify, sub-rent, or dispose of the Equipment under any circumstances.
2. Booking, Payments, and Security Holds
2.1 Rates and Payment
All rental prices are calculated on a per-calendar-day basis, starting from your selected “Start Date” and ending on your selected “End Date.” Payments must be made in full via our website using our authorized payment processors (Stripe or PayPal) prior to the time of delivery.
2.2 Security Deposit / Pre-Authorization
- To protect against loss, theft, or severe damage, we reserve the right to process a refundable security deposit or place a credit card pre-authorization hold of €50 before handing over the Equipment.
- This hold is not a charge and will be fully released or refunded within 3 to 5 business days after the Equipment is successfully returned to us in good working condition.
3. Delivery, Handover, and Return Logistics
3.1 Airport and Hotel Deliveries
- Airport Pickups: It is your responsibility to provide accurate flight details (Flight Number and Estimated Arrival Time). We are not liable for delayed handovers resulting from unannounced flight changes or incorrect information.
- Hotel/Riad Deliveries: If you request delivery to a Riad or Hotel, delivery is deemed complete once the package is handed to the reception desk or front concierge.
3.2 Timely Returns
- The Equipment must be returned to our designated representative, airport drop-off point, or via our prepaid shipping envelope on or before the “End Date” of your contract.
- Late Fees: If the device is not returned within 24 hours following your designated End Date, a late fee of [e.g., €10 / 100 MAD] per day will be automatically charged to your card on file until the device is returned or declared lost.
4. Loss, Theft, and Damage Fees
You are entirely responsible for the physical safekeeping of the Equipment during the rental period. In the event that parts of the package are missing or destroyed, the following standard replacement fees apply and will be charged to your card on file or deducted from your security deposit:
| Item Lost / Unrepairable | Replacement Penalty Fee |
| Pocket Wi-Fi Hotspot Router | [e.g., €100 / 1,000 MAD] |
| Sim Card (Inside Router) | [e.g., €15 / 150 MAD] |
| Protective Travel Pouch | [e.g., €5 / 50 MAD] |
| USB Cable | [e.g., €3 / 30 MAD] |
⚠️ Note on Theft: In case of theft, you must notify us immediately and provide a copy of the official police report (Rapport de Police) filed with the local Moroccan authorities to waive a portion of the penalty, subject to our sole discretion.
5. Fair Usage Policy (FUP) & Network Service Limitations
5.1 Fair Usage Policy
While your plan provides “Unlimited Internet Data,” service speeds are governed by the local Moroccan telecommunications backbone infrastructures (such as Maroc Telecom). To prevent network abuse, high-speed 4G/5G capabilities are subject to a soft daily cap of 3GB per day. If exceeded, speeds may be throttled until the daily reset time (00:00 local time).
5.2 Territorial and Signal Coverage Limitations
- The Equipment functions strictly within the borders of Morocco. It will not connect internationally.
- We utilize the strongest available network backbones in Morocco. However, we cannot guarantee uninterrupted connection speeds in deep topographical dead zones, including but not limited to deep hollows of the Sahara dunes, high high-altitude Atlas mountain passes, or behind thick historical stone walls of traditional Medinas. No refunds will be issued for localized network drops due to natural geography.
6. Cancellations and Refund Policy
We understand that travel plans change. Our WordPress cancellation window is structured as follows:
- Cancellation > 48 Hours Before Start Date: Full 100% refund of the rental fee.
- Cancellation < 48 Hours Before Start Date: A processing/restocking fee equal to 1 day of rental will be deducted; the remaining balance will be refunded.
- Early Returns: No partial refunds are issued if you choose to return the device earlier than your contracted End Date.
7. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any legal disputes, claims, or proceedings arising out of or in connection with this agreement that cannot be settled amicably shall be subject to the exclusive jurisdiction of the courts of Agadir, Morocco.
